This domain and our related business identifiers have been operated continuously by Adelaide Whitegoods Specialists Pty Ltd 30 Jul 2010, EDGE OF TOMORROW PTY LTD 27 May 2014 – 07 Nov 2019, and ADELAIDE CORPORATE PTY LTD 07 Nov 2019 (current), with this domain itself registered since 4 June 2015. This page serves as notice to prevent competitors from using our long-serving business identifiers, or transpositions of them, to confuse customers and search engines or to hijack our search traffic.
Trade mark TM2572451 is currently registered and active. Trade mark TM2621736 is accepted and awaiting publication. Unauthorised use of either mark or confusingly similar variants may constitute infringement under s 120 of the Trade Marks Act 1995 (Cth).
✓ Hidden source code use is trade mark use. In Accor Australia & New Zealand Hospitality Pty Ltd v Liv Pty Ltd [2017] FCAFC 56, the Full Federal Court held that embedding a competitor's trade mark in a website's source code or metadata constitutes "use as a trade mark" for infringement purposes — even where no consumer ever sees it. Embedding "Adelaide Appliance Specialists™", "The Appliance Specialists™", or confusing variants in hidden metadata, schema markup, or structured data may itself constitute trade mark infringement under s 120 of the Trade Marks Act 1995 (Cth), independent of whether it misleads anyone.
✓ Misleading affiliation is unlawful regardless. In ACCC v Employsure Pty Ltd [2021] FCAFC 142, the Full Federal Court found that advertising which, viewed as a whole, leads an ordinary or reasonable consumer to believe a false affiliation exists breaches s 18 of the Australian Consumer Law. Any use of our business name or trade marks — in ad copy, page content, structured data, or AI/search-indexed material — that conveys a false impression of association with Adelaide Corporate Pty Ltd or its brands may contravene the ACL, regardless of registration status.
i Note on keyword bidding. Veda Advantage Ltd v Malouf Group Enterprises Pty Ltd [2016] FCA 255 confirms that bidding on a competitor's name as a search keyword trigger is not, by itself, trade mark infringement, provided the resulting ad copy and visible content do not display the mark or imply affiliation. The distinction is between invisible keyword targeting (generally permitted) and visible or source-embedded use of our identifiers (addressed above).
